This Policy explains how we collect, use, share, and protect your information and your rights under applicable laws (including PIPEDA/GDPR/CCPA, where applicable). By using our App/Site, you agree to this Policy.
1. Information We Collect
- Account Data: email, nickname/avatar, country/region, language, time zone.
- Health & Mood Data (Sensitive): sleep duration/patterns, mood check-ins, meditation/breathing durations; upon explicit consent, non-medical wearable metrics (e.g., HR/HRV/respiration/steps).
- AI Interaction Data: text/voice chats with AI guides/mentors, interaction logs, derived personalization features.
- Transactions & Orders: subscriptions and shop purchases, billing/shipping (payments via compliant gateways; no full card/CVV stored).
- Device & Usage: device model, OS/app version, cookies/SDK IDs, crash/performance logs, coarse IP-based location.
2. How We Use Information
Provide/maintain services (personalization, device sync, account/order, support); improve/security (analytics, diagnostics, anti-abuse); legal compliance; and consent-based marketing (opt-out anytime).
3. Legal Bases (GDPR)
Contract necessity; Consent; Legitimate interests; Legal obligations.
4. Sharing & Processors
We do not sell or rent your data. Limited sharing with payments/billing, cloud/infrastructure, AI/content processors, logistics/fulfillment, and lawful disclosures under NDAs and DPA terms.
5. International Transfers
Your data may be processed outside your jurisdiction (e.g., Canada/US). We use appropriate safeguards (e.g., SCCs) and technical measures.
6. Cookies/Similar Tech
Used for login state, preferences, analytics, and UX. Manage cookies in your browser/device; some features may be limited if disabled.
7. Retention & Deletion
Generally 24 months after last activity, then delete/anonymize unless longer retention is required by law. You can request deletion (subject to legal/defense retention).
8. Children
If under 16 (or local age threshold), use only with parental consent/supervision. We do not knowingly collect minors’ sensitive data.
9. Your Rights
Access, rectification, deletion, restriction/objection, portability, consent withdrawal, and the right to complain to a regulator.

10. Security
TLS/SSL, least-privilege access, audit/monitoring, and (where applicable) encryption-at-rest. No system is 100% secure.

We are not responsible for third-party sites/services. Review their policies.
12. Updates & Language
We may update this Policy and notify in-app for material changes.
In case of discrepancy, the Company reserves the right of final interpretation.

By accessing or using the Services, you agree to these Terms.
1) Services & Critical Non-Medical Disclaimer
- Not Medical/Therapeutic Care: The Services (AI chats, audio, courses, “energy/frequency/mind-body-spirit” content, stories/examples, lifestyle tips) are for relaxation, lifestyle support, education, and self-reflection only; not medical advice, diagnosis, psychotherapy, or prescriptions, and no outcomes are guaranteed.
- Emergencies/Crisis: If experiencing suicidal ideation, self-harm risk, severe depression/panic, psychosis, seizures, chest pain/breathing difficulty, stop using and seek immediate medical help or call local emergency numbers (e.g., 120/911). We do not provide crisis or emergency medical services.
- Prohibited/Cautionary Use: do not use while driving, operating heavy machinery, working at heights/in water, or any high-attention activity; do not use under alcohol/illicit drugs/impairing medications; consult a clinician if pregnant or with serious cardiovascular/respiratory/neurological conditions, PTSD, or seizure history; discontinue if dizziness/palpitations/nausea/distress/trauma recall occurs.
- Religion & Mind-Body-Spirit: related content is for general reflection and lifestyle enhancement, not religious doctrine/endorsement or comparative claims.
- Examples/Stories: all are general references only and not tailored to particular persons or clinical relationships.
- AI Limits: AI outputs may be incomplete/inaccurate/unsuitable; verify independently and use at your own risk; do not replace professional medical/legal/financial advice.
2) Accounts & Eligibility
You must have legal capacity and keep information accurate and up-to-date; we may refuse/terminate for risk/compliance reasons.
3) Subscriptions, Payments & Shop
Fees are non-refundable for the current period. Shop orders subject to availability, logistics, duties, force majeure. Wearables/companions are lifestyle devices, not medical devices; not for diagnosis/treatment.
4) Acceptable Use & Safety
No unlawful/infringing/abusive/false content; no reverse engineering/scraping/bypass/attacks; no replacing professional care or efficacy claims; do not use during driving/heights/water/mechanized operations or under alcohol/drugs.
5) User Content & License
You own your UGC and grant us a worldwide, royalty-free, sublicensable, non-exclusive license to host/process/adapt/display it to provide/improve/promote the Services (subject to privacy/law).
6) IP Rights
All platform content (audio, courses, copy, UI, marks, algorithms/model outputs) is protected. No reproduction, adaptation, distribution, model-training, or commercial use without written consent.
7) Third-Party Services
Payments, logistics, cloud/AI, and linked sites are provided by third parties at your and their risk. No warranties regarding availability/compliance.
8) Limitation of Liability & Disclaimers
To the fullest extent permitted by law:
- No liability for indirect/incidental/punitive/special/consequential damages arising from use/inability to use, AI errors, data loss, device/network issues, third-party services, force majeure;
- Aggregate direct liability capped at the greater of (i) fees paid in the 12 months prior to the claim, or (ii) CAD 100;
- No medical/fitness-for-purpose warranties; Services provided “as is”/“as available.”
Consumer rights that cannot be excluded remain unaffected.
9) Indemnity
You will defend and hold us harmless from claims/penalties arising from your unlawful use or breach (except where prohibited by law).
10) Termination
We may limit/terminate (in whole/part) upon notice if you breach these Terms or pose risks, and may retain records as required by law.
11) Applicable Entity, Governing Law & Disputes
- Contracting Entity: unless otherwise agreed in writing—Mainland China users contract with Beijing: 北京睡美疗愈互联网科技有限公司; Canada/North America and other countries users contract with Canada: 睡美疗愈 Sleepbeauty Wellenss Inc.; for cross-border use, the entity shown on order/payment/invoice applies.
- Governing Law & Forum:
- Mainland China users: laws of the People’s Republic of China; disputes submitted to a competent People’s Court in Beijing.
- Canada/North America users: laws of the Province of British Columbia, Canada; disputes under the exclusive jurisdiction of the courts in Vancouver, BC.
12) Changes & Language
We may update these Terms and notify in-app for material changes. In case of discrepancy, the English version prevails.
